FAQ

Questions about a lawsuit

I've been served. How long do I have to respond?

Not long. The rules of the court where you were sued set the deadline, and it is often a matter of weeks. Missing it can mean losing by default, so send us the papers the day you get them.

Do you represent the side suing or the side being sued?

Both. About as many of our cases start with a demand we send as with a complaint someone else filed.

Who are your clients?

Owner-run companies and their owners, in disputes over contracts, partnerships, construction and property. We don't handle personal injury, family or criminal cases.

How long does a lawsuit take?

Months at the least, and often more than a year if it goes through discovery. We give you an estimate for each stage at the assessment.

What will the whole case cost?

Add up the stages you need. Many cases end at the demand stage or at mediation, so most clients never pay for all six.

Do I have to come to Charlotte?

No. We meet by video. If a court needs you in person, we tell you well in advance and meet you there.

My contract has an arbitration clause. Can you still help?

Yes. Arbitration runs through the same stages and the same fees; the arbitrator's fees are separate.

Can I recover my attorney's fees?

Only if a contract or a law says so. We read for that at the assessment and tell you.

Will you take a share of the recovery instead of a fee?

No. We work on flat fees by stage only.

What should I not do while a case is open?

Don't post about it, don't delete emails or texts, and don't talk to the other side without us. We send a short written list at the start.

Not answered here?

Write a few lines about the dispute and we reply with an answer, or with a time to talk.
